Introduction

This Privacy Policy (the "Policy") describes the practices of Ignis Labs LLC and its affiliates (hereinafter "VibeVerse", "we" or "us") with respect to the Personal Information collected, stored, used, transferred, shared and otherwise processed from or of our users, visitors, business partners, and other persons ("you") in connection with the VibeVerse mobile application, including all products and services related to it (all collectively, the "App" or the "Services"). This Policy is part of our Terms and Conditions ("Terms").

"Personal Information" means, as applicable, information related to an identified or identifiable natural person as defined by Regulation (EU) 2016/679 ("GDPR"), the UK Data Protection Act 2018 ("UK Data Act"), the California Consumer Privacy Act ("CCPA"), the Virginia Consumer Data Protection Act ("VCDPA"), and other applicable privacy laws (the GDPR, the UK Data Act, the CCPA and any other applicable data protection laws, when and as applicable, being referred to as the "Law"), including also sensitive data, if the case ("Personal Information"). The applicable Privacy Policy provisions may vary based on your residency and will align with the applicable Law, as appropriate.

The controller is Ignis Labs LLC, a Connecticut limited liability company with its registered office at 20 Thayer Avenue, Canton, CT 06019.

This Policy sets forth your rights and remedies under the Law, so please read it carefully.

Please also note that VibeVerse is provided "as-is" and exists solely for informational and devotional purposes. VibeVerse strives to offer Scripture-based encouragement and insight, but the app does not provide medical, psychological, legal, or pastoral counseling. Users experiencing emotional distress, mental health concerns, or any other serious life challenges should seek personalized support from a qualified counselor, licensed medical professional, or trusted pastoral caregiver. Reliance on the content provided by VibeVerse is at the user's own risk; in urgent or emergency situations, users should call local emergency services immediately (for example, 911 in the U.S. or 112 in Europe).

The following describes the Personal Information we collect:

User Data

This is Personal Information that is provided by you as a user of the App directly or through your engagements with and in the App. This data may include, without limitation, your email, user name, indirect identifiers, age range, log files, the dates and times of access, browsing and search history, information about the links you click, pages you view, and other information about how you use the Services, and technology on the devices you use to access the Services.

Inputs and Outputs

VibeVerse is designed to provide personalized Scripture-based encouragement and devotional content using artificial intelligence. By using VibeVerse, you have the option to prompt the Services with information about how you're feeling, prayer requests, and other text inputs ("Inputs"), which generate content such as Bible verses, devotionals, and reflections ("Outputs") based on your Inputs. If you include Personal Information in your Inputs, we will collect that information, and this information may be reproduced in the Outputs.

Prayer Privacy Notice: Prayers submitted through the prayer feature are processed transiently and are NOT stored or retained by VibeVerse. Your prayers are between you and God.

How AI Processes Your Data

VibeVerse uses artificial intelligence technology, including third-party AI services such as Google's Gemini API, to analyze your Inputs and generate personalized Outputs. When you describe your feelings, submit prayer requests, or interact with our personalized features, this information is transmitted to and processed by AI systems in real-time.

Our AI features utilize third-party services, including Google's Gemini API. Your Inputs may be transmitted to these providers for processing. These third-party services have their own privacy policies and data handling practices:

We may use anonymized and de-identified data derived from your Inputs to improve our AI models and enhance the quality of our Services. Before using any data for AI training:

Opting Out of AI Training

You may opt out of having your data used for AI model training by emailing contact@ignislabsllc.com with the subject line "AI Training Opt-Out." Please include your account email address. Note that opting out does not affect the real-time AI processing necessary to provide the Services.

Sensitive Data Consent

Given the spiritual and devotional nature of VibeVerse, you may share sensitive information including religious beliefs, emotional states, and personal circumstances. BY USING OUR AI-POWERED FEATURES, YOU PROVIDE EXPRESS CONSENT for the collection and processing of this sensitive Personal Information as described in this Policy.

Data Retention for AI Features

Inputs processed by AI for real-time content generation are not permanently stored unless you save content to your favorites or account. Anonymized data used for service improvement is retained in accordance with our general retention policies.

AI Accuracy Disclaimer

AI-generated content may contain inaccuracies and may not reflect all theological perspectives. Users should verify Scripture references and not rely on AI outputs as professional medical, psychological, legal, or pastoral advice.

Online Identification Data

This is Personal Information that is collected about you when you access and/or use and visit the App. This data may include device identifiers (including, if you permit tracking through the Apple App Tracking Transparency prompt, your device's advertising identifier (IDFA)), IP addresses, the type of device/operating system/browser used to access the Services, app activity events (such as app install and launch), and usage analytics. These technologies help us to recognize you, customize or personalize your experience, analyze the use of our Services, and measure the performance of our advertising.

Communication Information

If you communicate with us, we collect your name, contact information, and the contents of any messages you send.

Favorites and Preferences

We collect information about your favorite verses, Bible version preferences, and other app settings to personalize your experience and sync your data across sessions.

Purpose and Basis of Processing

When you use or interact with the Services we offer, we use a variety of technologies to process the Personal Information we collect about you for various purposes. The legal basis column applies to you when the GDPR or the UK Data Act applies or when the applicable Law otherwise requires the disclosure of the purpose.

When we process your Personal Information based on your consent or based on contract, if we have a legitimate interest after the contract ends or you withdraw your consent, we may continue processing the Personal Information based on our legitimate interest, if applicable and in accordance with the Law.

Please note that some of the Personal Information you provide may qualify as sensitive data/special categories of data (such as religious beliefs) and which we can process only based on your express consent. You may withdraw your consent for the processing in relation to some or all the purposes below (by sending us an email at contact@ignislabsllc.com), but please note that we will not be able to allow you to use the App without having your such express consent to process the sensitive data for those purposes that are closely linked to the App's use and functionality.

To Prevent Fraud and Abuse

Purpose: To prevent, detect, investigate fraud, abuse, violations and other trust and safety protocols of our Terms, unlawful or criminal activity, unauthorized access to or use of Personal Information or VibeVerse systems and networks, to protect our rights and the rights of others, and to meet legal, governmental, and institutional policy obligations.

Collecting Your Data

Where data is requested directly from you, VibeVerse asks you to provide those categories of Personal Information that we require for the purposes mentioned above.

VibeVerse may obtain Personal Information from third party sources, including third-party analytics services.

Sharing Personal Information

There are certain circumstances in which we may disclose, transfer or share your data with certain third parties with or without notifying you in advance, as you will see below:

Service Providers

For the purposes described in this Policy, such as business and App functionality purposes, including Services and data hosting, cloud hosting, data processing, and analytics, we work with service providers who work on our behalf and who may need access to certain Personal Information in order to provide their services to us and for us to provide our Services to you. These companies include providers of hosting services, cloud services, database management, AI services (such as Google's Gemini API), and analytics services.

Payment Processors

We (but most likely you directly) will share your Personal Information with our payment processors (such as Apple) as necessary to enable them to process your payments and for anti-fraud purposes.

Advertising Partners

We share certain Personal Information with third-party advertising partners, currently TikTok (through the TikTok Business SDK integrated in the App), to measure the performance of our advertising campaigns, to attribute App installs and subscription purchases to those campaigns, and, where you have permitted tracking, to support personalized advertising. The information shared may include device information (such as device model, operating system version, and IP address), app activity events (such as app install and launch), subscription purchase information (product identifier, product name, price, currency, and a transaction identifier), and, only if you allow tracking through the Apple App Tracking Transparency prompt, your device's advertising identifier (IDFA). Under certain U.S. state privacy laws (including the CCPA), this disclosure may constitute a "sale" of Personal Information or "sharing" of Personal Information for cross-context behavioral or targeted advertising. You may opt out as described under "Your Rights Under US Privacy Laws" below. You can also allow or disallow the use of your device's advertising identifier at any time on iOS in Settings > Privacy & Security > Tracking.

Law Enforcement

We share your Personal Information when we believe in good faith that it is necessary to do so in order to comply with a legal obligation under applicable law. We also share your Personal Information when we have a good-faith belief that doing so is necessary for our legitimate interests, rights and safety or those of a third party.

Buyers of Our Business

We will share your Personal Information if we sell or negotiate the sale of our business, assets and/or data to a buyer or potential buyer, if we are involved in corporate transactions, bankruptcy, change of control or other situation involving the transfer of our business, assets and/or data.

Relevant Authorities

We will share your Personal Information with governmental regulatory authorities, as required by law, including for legal, tax or accounting purposes, in response to their requests for such information or to assist in investigations, based on their legal obligations.

VibeVerse Employees and Contractors

In order to ensure that all the Services on the App are working and to guarantee compliance with the applicable legislation, VibeVerse's collaborators and contractors may process your Personal Information.

Third Parties

We may also disclose Personal Information to third parties in connection with claims, disputes or litigation, when otherwise permitted or required by law, or if we determine its disclosure is necessary to protect the health and safety of you or any other person, to protect against fraud or credit risk, to enforce our legal rights or the legal rights of others, to enforce contractual commitments that you have made, or as otherwise permitted or required by applicable law.

With Your Consent

VibeVerse will otherwise disclose Personal Information when you give us permission or direct us to disclose this information.

Data Security

We have implemented reasonable and appropriate physical, technical and organizational measures to protect the data we collect and to prevent unauthorized access, disclosure and misuse of your Personal Information, such as encryption. Our Services may involve integrations with, or may direct you to, websites, apps, and services managed by third parties. By interacting with these third parties, you are providing information directly to the third party and not to VibeVerse and you are subject to the third party's privacy policy.

Children

To use our Services, you must be at least 13 years old. VibeVerse does not knowingly collect Personal Information from children under 13. If you are a parent or guardian and believe your child under 13 has provided us with Personal Information, please contact us at contact@ignislabsllc.com and we will take steps to delete such information.

Retention Period

We will store and process your Personal Information for the period of time necessary to achieve the purposes described in this Policy and in accordance with our legal and contractual obligations. For the use of the App, we store your data for the duration of such use and for up to 5 years after your termination of any use of the Services or deletion of your account (whichever occurs last), unless otherwise required by law or unless we have legitimate interests that allow us to do so for a longer term. Thereafter, the data will be erased in accordance with our procedures, which may involve anonymization or destruction. If you ask us to, we will delete or anonymize your Personal Information so that it can no longer be identified, unless we are permitted or required by law to retain certain Personal Information, including in situations such as the following:

Your Rights as Per GDPR and UK Data Act

You have a number of rights in relation to VibeVerse, which you can exercise by sending an e-mail to contact@ignislabsllc.com.

Right to Information

You have the right to know how we handle your Personal Information in an appropriate and transparent way and what rights you can exercise in this respect. In this Policy, we have explained in detail what Personal Information we collect from you and how we handle your Personal Information.

Right of Access

You have the right to access your Personal Information we hold at any time. Please include your account ID, name and e-mail address. In addition, we may ask you questions to verify your identity.

Right to Rectification

You have the right to rectify the Personal Information we hold about you where it is incorrect or out of date and/or to complete such data where it is incomplete. Please note that we cannot guarantee the factual accuracy of AI-generated Outputs.

Right to Withdraw

This right entitles you to object to further processing of your Personal Information under the conditions and within the limits provided by law. In particular, if you have given your consent to our use of your Personal Information, you have the right to withdraw this consent at any time.

Right to Object to Direct Marketing

If Personal Information is processed for direct marketing purposes, you have the right to object at any time and free of charge to the processing of your Personal Information for direct marketing purposes by clicking on the "Unsubscribe" box when you receive such an email.

How to Unsubscribe from Communications

To stop receiving push notifications: On iPhone, go to Settings > Notifications > VibeVerse > Toggle off "Allow Notifications". You can also manage notification preferences within the VibeVerse app settings.

To unsubscribe from all non-essential communications: Email contact@ignislabsllc.com with the subject line "Unsubscribe" and include your account email address. Note that we may still send you essential service-related communications (such as security alerts and policy updates) as permitted by law.

How to Cancel Your Subscription

You may cancel your subscription at any time. To avoid being charged for the next billing period, you must cancel at least 24 hours before your current period ends.

To cancel within the VibeVerse app:

  1. Open the VibeVerse app
  2. Go to the Journey page
  3. Tap the "Subscription" button
  4. Follow the prompts to manage or cancel your subscription

To cancel via iPhone Settings:

  1. Open the Settings app on your device
  2. Tap your name at the top of the screen
  3. Tap "Subscriptions"
  4. Find and tap "VibeVerse"
  5. Tap "Cancel Subscription" and confirm

To cancel via the App Store app:

  1. Open the App Store app
  2. Tap your profile icon at the top right
  3. Tap "Subscriptions"
  4. Find and tap "VibeVerse"
  5. Tap "Cancel Subscription" and confirm

IMPORTANT: Deleting the app does NOT cancel your subscription. You must follow one of the methods above to cancel and stop future charges.

Right to Data Portability

You have the right to receive the Personal Information you have provided to us, in the context of the agreement you have entered into with us, to store this Personal Information in a database of your own or a third party.

Right to Restriction of Processing

You have the right to obtain restriction of the processing of your Personal Information in certain cases (for example, where you contest the accuracy of your Personal Information, for a period of time, to allow us to verify the accuracy).

Right to Have Your Account Forgotten/Deleted

In some cases, you have the right to be forgotten. In this case, we will assess whether we can delete your data or whether we need to retain certain data to comply with a legal obligation. You can ask us to delete (part of) your Personal Information.

Right to Complain

If you disagree with the way we handle your Personal Information, you have the right to lodge a complaint. If you have a complaint, we would like to resolve it with you first. Please include your name, e-mail address and account ID when contacting us.

You also have the right to lodge a complaint with your local data protection supervisory authority. A full list of EU supervisory authorities' contact details is available at https://edpb.europa.eu/about-edpb/about-edpb/members_en. In the UK, you have the right to lodge a complaint with the UK Information Commissioner's Office.

There is usually no fee for exercising the above rights. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

Your Rights Under US Privacy Laws (Including CCPA and VCDPA) for US Residents

You have certain rights in relation to VibeVerse, which you can exercise by sending an e-mail to contact@ignislabsllc.com. You can invoke the consumer rights authorized at any time by submitting a request to VibeVerse specifying the consumer rights you are invoking.

Rights You Have as a Consumer

Request to Opt Out / Do Not Track

You have the right to opt out of sharing your personal information with our analytics and advertising partners (including TikTok, as described under "Advertising Partners" above) and from selling your data. To exercise this right, you can stop the use of your device's advertising identifier for tracking at any time on iOS in Settings > Privacy & Security > Tracking.

Right to Limit the Use of Sensitive Personal Information

Under certain U.S state laws, you may have the right to limit the use or disclosure of your sensitive data (such as religious beliefs) to certain purposes such as to a) conduct internal research to improve, repair, or develop products, services, or technology, b) provide a product or service specifically requested by a consumer, c) maintain the security and integrity of our Services, systems, and data, prevent fraud or illegal activities, and protect individuals' physical safety, and d) any other purposes allowed by future regulations under applicable U.S. state data privacy laws.

Right to Complain

VibeVerse shall respond to you without undue delay, but in all cases within 45 days of receipt of the request. The response period may be extended once by 45 additional days when reasonably necessary, considering the complexity and number of the consumer's requests, but we shall inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

If VibeVerse declines to take action regarding your request, we shall inform you without undue delay, but in all cases and at the latest within 45 days of receipt of the request, of the justification for declining to take action and also VibeVerse shall provide instructions for how to appeal the declined decision.

In the unlikely case of having your request declined by VibeVerse, you can appeal by sending a sufficiently substantiated notice to contact@ignislabsllc.com.

Within 60 days of receipt of an appeal, VibeVerse will inform you in writing of any action taken in response to the appeal, including a written explanation of the reasons for the decision. If the appeal is denied, VibeVerse will provide you a method through which you can contact the Attorney General to submit a complaint.

Non-Discrimination

Under U.S. state privacy laws, businesses are prohibited from discriminating against you for exercising your rights under the law. This includes actions such as denying you a product or service, offering a lower quality or different level of service, or charging you higher prices. However, the California Consumer Privacy Act (CCPA) allows businesses to offer different levels or qualities of service or charge different prices, provided the business can demonstrate that these differences are reasonably tied to the value the consumer's personal information brings to the business.

Transfers to Other Countries

Ignis Labs LLC is based in the United States. Personal Information we collect may be transferred to and processed in the United States. Some of our third-party providers may be based outside the United States. Their processing of your Personal Information will involve a transfer of data outside the US.

For users in the European Union or United Kingdom, whenever we transfer your Personal Information outside the EU or the UK, we endeavor to ensure that one of the following safeguards is in place:

Changes to Our Policy

We may change this Policy from time to time. If we make material changes to the way in which we use or disclose information we collect, we will use reasonable efforts to notify you (such as by posting notice of such changes on the Services, or by other means consistent with applicable law) and will take additional steps as required by applicable law. If permitted by law, your continued use of the Services after this Policy has been updated indicates your acceptance of changes made. In some cases, you will be given a choice to accept changes to this Policy. If you do not accept the terms of the updated Policy, you are not allowed to continue using or accessing the Services.
